About us

Daveclar General Merchant & Merchandise L.L.C. is a general merchant company based in Staples, Minnesota. We supply general merchandise, source equipment and products for buyers, and — as one part of our work — help former property owners recover surplus funds held by county clerks in Florida.

Surplus recovery

What is tax deed surplus? When a Florida property is sold at a county tax deed sale, the sale sometimes brings in more money than the taxes and fees owed. The extra amount — the surplus — is not the county's to keep. By law, the Clerk of Court holds it for the former owner. Most former owners never learn this money exists: the Clerk sends a single mailed notice, and if it goes to an old address, the surplus simply sits unclaimed. We locate former owners, verify their surplus with the Clerk, and help them recover it.

How it works

  1. We find your case and verify the amount. We confirm your surplus and the exact amount directly with the County Clerk before asking you to sign anything. You can confirm it yourself the same way — call the Clerk and ask about your tax deed case number.
  2. You sign two forms. We fill in the forms for you. One is the Clerk's claim form, which must be notarized. The other is our agreement, which lets the Clerk pay our fee out of the recovery.
  3. We file and follow up. We submit the claim, answer the Clerk's questions, and track it until the Clerk pays. The Clerk pays you your share, minus our fee if you hired us.

Our terms, stated plainly

You can always claim your surplus yourself, free, directly from the County Clerk. Many people do. Our service exists for owners who would rather not deal with the paperwork, the notary, and the follow-up.

If you hire us, our fee is a percentage of what is actually recovered, and it is paid only out of a successful recovery. Never upfront. Nothing if nothing is recovered. The exact percentage is written in the agreement you sign before we file anything — no surprises.

Common questions

Is this a scam? How do I verify it?
Check us the same way we check your case. Call the County Clerk's office directly and ask about your tax deed case number — the Clerk will confirm whether a surplus is being held and for how much. We are a Minnesota limited liability company — Daveclar General Merchant & Merchandise L.L.C. — and our business filing is a public record with the Minnesota Secretary of State. Never send money to anyone who asks for an upfront fee to release surplus funds — we don't.
Why didn't I know about this money?
Because the notice system is a single mailed letter. After a tax deed sale, the Clerk mails one notice of surplus funds to the owner's address in the county's records. Owners move, mail goes astray, estates are settled by family members who never see the letter. If the notice misses you, nothing else follows — the money just sits.
What does it cost me if the claim fails?
Nothing. Our fee comes only out of money actually recovered. If the Clerk denies the claim or no surplus is paid, you owe us nothing.
How long does it take?
It depends on the county and the Clerk's workload. Claims commonly take a few months from filing to payment, and contested or estate cases can take longer. We will tell you what the Clerk tells us, as it happens.
What do you need from me?
Two signed forms — the Clerk's claim form (notarized) and our agreement — plus a copy of your photo ID. We prefill everything else. If the owner is deceased, the Clerk may require estate documents; we will tell you exactly what is needed for your case.
Do I have to use your company?
No. Every owner has the right to file their own claim with the Clerk at no cost. We earn our fee only from owners who prefer to have someone handle the process for them.
